I just want this over already! My car be totaled by another driver on the freeway and I was 0% at Fault and my attorney seems to be slacking! Does anyone hold any advice?
Answers:
Find another attorney and fire the one you have.
Ha. We must have the same legal representative then. Ask to speak to another person specifically handling your case.
Send him both a letter and an e-mail recounting him that because of his lack of response, you assume he is no longer pursuing your case and that you intend to aim another attorney. Tell him that unless you hear otherwise within 3 working days, you will consider the attorney-client relationship to be terminated and will retain the services of another attorney. That puts the ball contained by his court. If you don't hear from him, send him another letter stating that you enjoy hired another attorney and no longer require his services.
If he doesn't answer, besides getting a new attorney, consider calling your state's bar association and explaining your experience. He may be disciplined, as downfall to return calls and lack of communication are considered highly serious.
