What is the most used criminal defense?

& why?

It's the "tea bagger/birther" defense....well, it USED to be call the "Insanity defense", but they've now changed the term to include anyone that's not contained by their right mind.
Insanity is not the most commonly used because in instruct to plea legal insanity the defendant must prove first and foremost that he is indeed insane due to mental condition or defect. Also once an insanity defense is enter it cannot be changed, and it is hard to convince a jury that one is legally insane. However, Duress is a great trial defense and I see it all the time. Defendants will argue that because of the current circumstances at the time the crime was committed, whether that be they be broke and needed money fast, or somebody was threatening them and they "needed" to execute a criminal stroke to relieve that threat. So I would argue duress is most common.
AAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAA MAKE THE VOICES STOP! translation the insanity plea, beacuse it works.
everybody tries to pull the insanity card..but what they don't realize is that you are always evaluated by a court appointed consultant..unless your a total wacko..it never works.
Misidentifying of the suspect. "You've got the wrong guy!"
Self defense. "I feared for my energy."
Insanity. "God told me to murder all those people."

Why because when the facts are nearby, defense lawyers will use these things to create even the slightest doubt in the jury's minds.

I know they are more afterwards one. I was going for the top three.
"I didn't know it was illegal". unfortunately here is a law against that too!
