I am doing a paper on the "Legal and Ethical Obligations of Defense Lawyers". I have found most of the official obligations but i am struggling to differentiate between those and the ethical obligations.HELP! some possible books would be excellent.
Answers:
every lawyer including defense attorneys are obligated to practice canon according to the rules of professional responsibility for lawyers. see them below. Source(s): http://www.abanet.org/cpr/mrpc/mrpc_toc.…
You are likely having a problem beside this because most all of the ethical obligations of an attorney (any) are codified, consequence they have been written into "law." These are codified by the individual states. There also exists the "Model Rules of Professional Responsibility." start with the American Bar Association.

Ethical obligation are set forth in the Rules of Professional Conduct in effect contained by the State in which one is admitted to practice. All trial obligations are also ethical obligations, since an attorney must, as a issue of ethics, obey the decree. Violation of purely ethical obligations, on the other hand, can result contained by professional discipline, but don't have force apart from the legal profession itself. I believe (though I could be wrong just about this) that a violation of the RPC would not, in itself, amount to a grounds of action for a lawsuit by a client. It could, however, result in your mortal reprimanded, suspended from practice, or disbarred.
