Can I go to the court house and file for a divorce myself and later get a lawyer?
Or should I tolerate the lawyer do all the work?
I want to go the house she does not; who's going to win this?
Answers:
If you plan on hiring a legal representative anyway, don't file the paperwork - chances are near are details your lawyer could better advise you going on for. Once those papers are filed, it may be a pain to rework anything.
As far as who is going to "win" this? Besides the fact that it's impossible to tell, I hope you don't own children. You've set yourself up for a battle, when it doesn't have to be.
The correct answer is....OF COURSE YOU CAN.

You can hire, fire, rehire, attys can quit, die, etc throughout the natural life of the court process. You can hire an atty and later decide to represent yourself (pro se).

Now is it sage? Depends. If the case seemed to be uncontested and you wallet a joint petition only to find out the daytime before court that they were hiding money within the caymans...then of course hiring an atty is the best route.

Filing for divorce starts the court process. You can other (or an atty that you hire later on) amend virtually anything on the petition.

Most states allow even contested divorces for the parties to progress pro se. Some states though do not allow it--but even those you can file a waiver and go back the judge to state your reason for going pro se. Source(s): www.divorce4free.org
The only way you can do a divorce in need a lawyer is if its uncontested - if both parties agree on adjectives aspects of the divorce, which from the sounds of it, yours is not. If she does not want to sell the house, or disagrees with any other issue re: the divorce its considered contested and you will stipulation a lawyer to get it finalized. You might as capably let the lawyer do adjectives the work and get your money's worth - its gonna cost you a lot! Source(s): http://document-do-it-yourself-service.c…
