DWI information??
My friend received a DWI over the weekend from a Texas state trooper. He had a beer and the open container be still in the car. He took the check and the statetrooper said he took an extra step but I seen him and he didnt. I know everything is on camera which is great. He has never ever be in trouble before so it is his first offense. He also refuse to take a breathalyser. The state trooper was boasting as to how lots DWI he gets under his belt every week. I recognize that it was very stupid to own an open container in the motor but he had drank it before we not here and just didnt trash it. He is 24 and was not over the legalized limit. Although I am sure the Cop will say otherwise. I am looking for counsel from people who have be in a similar situation, only serious warning please. What will happen to his license? What will the fine be? Can he fight this surrounded by court and plead not guilty? How likely is it that he could have the charge dropped to a moment ago a Open Container offense?

Refusal to take a breath audition is grounds for an automatic 1 year revocation . He has 10 days to apply for a restricted license which will allow him to get to work and vertebrae .
His fine can vary but will be between 250-1000 .

So the DA may just enjoy his case layed out for him! He could be facing the loss of his licence and if there be no damage then his fines may be no more than roughly 3000 dollars. Sure, he can allways plead not guilty and the state will have to convince a judge or a jury that he be impared to the point of being illegal. Although they own no physical evidence since he refused to breath into the tube, many convictions are obtain based on the testimony and credibility of witnesses such as the officer.
I suspect your friends license have already been suspended. It would be in California for refuse a breathalyzer. He needs to get an attorney approaching now.
