DWI surrounded by New York State?

My ex-husband (read: EX..as in no longer with the loser) be charged with misdemeanor DWI. This is his fourth, with the ending one being nearly 20 years ago(he got three from the time he be 19-21)- never served jail time. He has have a clean arrest record for 18 years and a couple of minor driving violation. What should he expect when he goes in front of the find? How much can he expect the past record to effect his current situation and what is the likihood that he could run to jail? He blew a .09, and the legal target where we live (New York) is .08. As far as jail time, if no one be injured as a result of his drunk driving, he will not go to jail.
