DWI while sleeping contained by sports car?
I was arrested for DWI because I was sleeping contained by my car after having a hours of darkness out with some friends. I was a short time tipsy but I still did not want to drive until I had some time to sober up. While sleeping a cop pulled up to get something to chomp through at a restaurant that I was parked near and notice me in the car asleep. I hear him knock on my window but apparently did not respond as quickly as he considered necessary so he opened my door and had me step out of the vehicle and later arrested me after I refused to speak with him. Is at hand anything that I can do about these charges.
The video does not show him entering my vehicle without say-so but his report states that he did so. Also the keys were surrounded by the ignition when the cop arrived. I have a lawyer presently and he is looking over the charges.

Now you know, hide the key and definitely don't put them in the ignition if you are sleeping one rotten. I know you can't listen to the radio, but you just have to do business.
You will probably get this pled down to something other than a DUI if it is your first offense, as the prosecutor probably have other people he'd rather punish. But, subsequent time you will have more trouble. Of course, all this depends on the state, but most states work this course now.
It is common knowledge that If the key are in the ignition you are screwed! (It shows intent to drive) If you had taken the key out and thrown them on the floor on the passenger side or any where else you may have have a chance. Didn't your lawyer recount you? You won't like my answer, but it will be honest and truthful. If the key were in the ignition....he have probable cause. In the eyes of the law, you be passed out behind the wheel. He did not call for permission. You were smart not to read out anything. Refusing BT would have been a suitable thing also. Contacting a lawyer directly is the best posible response.
I don't condone people who drink and drive, but I do believe you should have every right to a legalized defense available and at your disposal.

Yea, whenever your in a car and the key are there, you can be charged for DWI. It sucks but yea. On the other hand, if he did enter criminally, then you MAY be able to catch out of the ticket but it'll be costly because you'll need to court and fight it. I hope you own a good lawyer.

The problem is at any given time you can start the saloon and leave and you were admittedly tipsy. I don't want my kids out doing a tour with anyone unless they are stone sober so I think the officer made the right call. Next time you want to sleep after you drink stay out of your car, telephone call a ride, and go home.
