I get a DWI the other daylight Will i be convicted?
i blew a 0.0 on the breathalyzer test but they also gave me a urine testing and i tested positive for methadone, morphine, codeine and 06-monoacetylmorphine. i am prescribed methadone by a doctor but the morphine, codeine and 06-monoacetylmorphine i'm not sure how i tested positive for, i've been doing some research and found that you could test a false positive from drinking poppy seeds and i eat poppy nut bagels with cream cheese everyday for breakfast

It could be that you really be under the influence and just did lousy on the breathalizer tryout, so the cops were not confident that you were cooperating. ~or~
They know you were high and really looked-for to get it documented.
You say your on methadone and poppy seed. First, know that the judge has hear the 'poppy seed' defense about a million times and it will not pan out ably as your defense. Judges are smart and that excuse will look like your on a fishing expedition. I wouldn't bring up the 'poppy seed' thing unless your attorney advises you to do so.... it could really hurt your credibility.
I am saying this merely in case your not anyone totally honest.....
If you are guilty, and the evidence is stacked against you... admit it and throw yourself on the mercy of the court. A judge will look favorably on you man honest and not wasting the courts time.
But if you are being totally honest.
go to the doctor who prescribed the methadone.... communicate him/her what happened....
they will be able to explain to you why the examination showed positives for these things.
It may be that they are saying you tested positive for this particular 'family' of drugs.
Regardless, your doctor can endow with you a statement that says you are currently under his/her guardianship for whatever you are being treated for and are on methadone for that root.
A judge is going to respond to a doctors professional opinion more so than yours.
If you blew 0 on the try-out you were not impaired and shouldnt be punished for this.
Come to court next to some paperwork to support you. Be VERY respectful. Explain that you are trying very hard to verbs your life up and dont understand how this happen. Play on the sympathy of the court. Most judges respond to that. Be a jerk and they will throw the book at you.... immediately.
Get a good lawyer.... you requirement one. Make sure to sit and talk with them awhile since you go to court.
you better obtain a damn good lawyer. It will be worth every single penny.
A lot depends on why you were originally pulled over. If they gave you a urine experiment, they probably had some good grounds to do so. Some of those substances stay in your system a long time, even after the effects that would keep from driving hold worn off. Most people know methadone as a drug for a recovering user and this will not look well-mannered for you, particularly since there are other drugs within your system. If you were prescribed methadone as a pain reliever, after you need verification from your doctor that you needed the drug, and you better enjoy a good reason for driving even if you be not showing the effects of the drug at the time. You could ask a good pharmacist about the breakdown products of methadone within your system, and also about how long you would expect to find the drug in your system after taking a dose. This could be moral for your defense. You need a good attorney, and you obligation to be very forthright with that attorney. In the meantime, heed the warning on your medicine bottles. They are there for a aim.
Likely that they will drop the DWI and charge you with Driving beneath the influence of drugs. Then most likely you could be convicted. A lot will depend on whether you have prior documentation if not then you could capture probation, if so then you will most likely do put in prison time(in most places not prison but local or county jail).
Make sure your lawyer knows the doc prescribed the methadone- that might cause a big difference. Did your doc give you any vicodin? Vicodin would cause the morphine , codiene and 06 to be within your system. Make sure your lawyer knows you have that as a prescription (if you did). Drugs your Doctor prescribes are legal!! And you had 0.0 on the alcohol oral exam. GET the best lawyer you can afford and you may be able to acquire out of this.
Whatever , you piece of sh*t !
I hope you budge to jail for a long time if you were driving around beneath the influence of drugs !
How stupid can you possibly be?
the poppy seed defense would only stand a snowball randomness in hell if you had tested positive for opiates, not adjectives the other crap you have been taking !
LOSER !
was your driving eradic? under the decree they could try to make those charges stick cause most of those drugs enjoy warnings on their labels caution you from driving a vehicle and that you may have side effects. see the whole driving while intoxicated doesn't a short time ago hold to liquor it also applies to marijuana, opium, morphine, and many other drugs that inhibit your reaction time while driving. I would "legal representative up" quick to see if it can be thrown out on some technicality. you were doing it malicioucly..
You can test positive for opiates from poppy seed, but nothing else.
And yes, you will probably be convicted.
As for the DWI, if the level of any substances in your system were ample to impair your driving ability, you may be convicted. Check with a local attorney to see your state's rules on impairment due to prescribed medication and the specific levels which were found contained by your case.
Yes, you will likely be convicted. The blood interview is looking for metabolites (chemicals produced by the human body only when you use the drugs tested for).
They had to enjoy probable cause to pull you over surrounded by the first place, and I'm sure you flunked the roadside sobriety test and demonstrated impairment.
Get a good attorney.
