CLAIMING AN OLD INJURY THAT GOT WORSE BECAUSE A CAR ACCIDENT!?

I recently had an fluke and got hit by a tire in the interstate, my sports car was severely damaged and I suffer some injuries. My insurance is dealing beside it as an insured motorist claim. My question is, years ago I had a surgery on my knees, since then it got better, but I injured it again during this stroke of luck, would it be a problem claiming it for a settlement??

it would depend on what the doctor say eg, if it was because of the old injury and don't regard as its that easy because if your doctor says its because of the luck the other party may demand proof which can be rugged to do.
It would quality as a pre-existing condition. Often times, pre-existing conditions can re-injure. I would make sure that you inform your insurance company of this. Also, clear an appt with the Dr you saw for the old injury to determine the extent of the different injuries. Always keep the insurance company of Dr appointments and their findings.
