Insurance options not explained? The approach rental companies make thier money is by selling the insurance options (cdw). If you be at fault for an accident the waiver would not prevent you human being at fault. If you have insurance than the applicable deductible applies (Comprehensive or Collision). If you look at the contract you got when you rented the sports car you will see that you initialed the paragraph that stated you knew and understood what your insurance option and liability were. If you didn't sign they wouldn't have rented you the vehicle.

In short you don't have a leg to stand on.
You don't think Budget has see that excuse before? Their lawyers probably own everything you could possibly say already worked out and know exactly how to respond to it. Basically, if you didn't get the insurance, it's your own bad habit. If you did get it, your terms and conditions are stated on the form they distribute you.

You'll probably end up spending a fortune in attorney fees and court fees, merely to lose. Unless there's something that would seriously (and I mean really really seriously) make your armour unique, I guess you can try to fight it - but you're probably better stale taking responsibility for your actions and paying up.
