If you purchase a saloon from an individual being, instead of a trader, does the lemon decree still cart effect?

My boyfriend just purchased a car from a guy and be totally ripped off. The check engine light shows as soon as you start up the motor, and they had black electrical tape over it. The saloon has been repainted because the previous owner be in so many wrecks. There is a few dents contained by the side, still because of the numerous wrecks, and the guy is acting like he had no opinion about it. He went to obtain it inspected, and there is a few things wrong internally, including the transmission, which would cost 2500 minimum to fix. The guy is immediately saying that he has already invested into a nother motor, for 3200. <-- how much my bf spent. I was wondering if the lemon law would pocket effect with this situation. Thanks so much for any help!

Not all states hold a lemon law and those that do specifically exclude used cars and private party transactions.
Typically when you buy a car from a private owner it's "as is." He should hold test-driven it, and if the owner said no, then he should have walk away.

Now if the previous owner had put it in writing that nearby was nothing wrong next to it, and there was, next he'd be in trouble.
I revulsion to inform you, but lemon laws only apply to vehicle purchased new and owned by the original owner. Even if you purchased it used from a buyer, it wouldn't matter. Source(s): I've been within the car business for 14 years.
No, the lemon law lone covers vehicles purchased from a legitimate trader. That is how it is in most states that have it and you don't indicate which state.

It's buyer beware and you might try small claims court. If bf can prove that he be defrauded, then he might acquire his money back. He should have have it inspected before he bought it, not after.
THIS IS WHY THE BUYER SHOULD TAKE THE CAR TO BE INSPECTED BEFORE THEY BUY IT. Your boyfriend has only made a classic bad investment. Next time, he'll know better & be able to engineer a more informed decision before he give up his hard earned currency. He's S.O.L.! PS, the "check engine light" is easily fixed by replacing the electronic plug-in part. It's individual a reminder light to get folks to check on their fluids & their emission equipment.
