What Exactly are Lemon Laws and how do I know it it applies to my situation?
My Gateway Laptop (btw, DONT ever buy one) is less tha 2 years old and have already broken twice for the same problem. It has trouble charging itself, the first time it simply wouldnt charge and the second time, it certainly caught on fire and fried my mother board. I have have it back for a month now and it is starting to work up again. In addition, the "mouse" button is breaking. Will sending it in a third time result within anything positive for me, such as getting a new computer that isnt a pile of junk? I own asked Best Buy and they have been for a time shady about the whole article.

Lemon law are for veichles, thus they don't apply here. Do you have a warranty on the laptop? If not then you're going to own a hard time getting anything worked on. As for suing them, you'll have to show that they know the device was defective and with that understanding still sold it. The battery problem is not Gateway's problem, but rather Sony. If you've see the news most if not adjectives computer makers have issued recall because of Sony batteries. Sony is going to be liable for any damages there defective battery cause, and they'd be the ones I'd file suit against if you've have to pay for any of the repairs because of the battery catching fire. If you do collect from Sony, document that Gateway will legally be able to ask you to wage them back if they provided the repair free of charge.
Lemon laws only apply to motor vehicle, how long is the warranty on the laptop for? If they warranty is expired, you're out of luck, if not, it's a legally binding agreement. Report them to the better business bureau.
I never hear of a lemon law on anything but cars. And any car next to 100,000+ miles on it is not covered under any lemon law.
I bought the extended warranty on this computer from Circuit City and they honored it when Hewlett Packard KEPT my behind the times computer that I returned under Mfr Warranty, and gave me a Piece of Crap "Refurbished" one instead!
I'm not sure Best Buy is the best place to shop after reading what you're going thru.
