I enjoy a personal injury lawsuit imminent. How long beforehand its settled?

My lawyer contacted me today saying that he is sending a "demand" memo for $100,000 . What exactly does that mean and what can I expect to happen in a minute? A lady, who was going away a service station, hit me on my bike. My bike was totalled, I was rushed to the hospital, received several stitches to the forehead, and have 2 blackeyes, cuts, bruises, aches, and pains. I have developed severe arthritis to my foot plus my psychiatrist indicates that my depression have increased significantly. How much longer will this go on, and will I actually be awarded some money? It hasn't be easy for me as I lost my fiance to COPD in December? My attorney isn't an easy one to get answers from. I've never sued anyone formerly and I don't know what to expect.

it may bring years and on the end the only population gaining will be
the lawyers
This can go on for years. But when it does settle, your advocate will take a 3rd off the top, next your physical therapist who he sent you to. Dont expect $100,000. You would get more close to half that, if that at all.
There is no quick way to jump about this. It is very unlikely that your attorney would have any success near a letter of demand. The nonspecific process (in QLD) would involve you lodging a claim in the District Court. At the end of the morning, you may be awarded damages (this could be years down the track), but if this person has no money and owns zilch then you'll get nought. In the mean time, your solicitor is billing you for his time. If you loose you could be made to pay not solitary your solicitors costs but also the costs for the other sides solicitor. If you win and can collect then you may also be awarded your solicitors costs. Before going any further take a righteous hard look at who you are suing, is it likely that they enjoy any money. Be wary of the lawyer who won't answer question, they may be the ambulance chaser type. Pick one that is going to be upfront with you and will readily answer question. In other words, don't bank on a settlement and weigh up all your option before committing yourself to a lawsuit.
