ICBC Personal Injury Claim Advice?
I was driving my dad's car to rob my parents to the airport. I had to stop suddenly and to avoid hitting the cars at a red light contained by front of me I swerved to the curb lane and smacked dead on into a pole. No other vehicles be involved. I believe the brakes didn't work. My dad and I were not seriously injured but my mom was. No broken bones or anything but severe twinge. My parents are seniors in their 70's. My dad has hasty Alzheimers so she was his caregiver and she also did babysitting for my nephew which she was salaried for. The car was a write rotten and they refused to check the brakes for fault.
How do we contract with ICBC so we get adjectives that we are entitled to? Do we need a lawyer to sue for damages or will ICBC award damages to her automatically? Any counsel dealing with ICBC would be appreciated. Thank you!
Answers:
First off when be the brakes last serviced? If it was recent and you hold receipts to prove it then liability rests with the shop. If you don't hold proof of repairs or if the brakes weren't serviced then there is no liability next to anyone other than the owner of the car for tactless maintenance and NO your insurance company will not inspect the brakes.
You are at fault for this luck. Your parents are responsible for the upkeep of their car and you are responsbile for knowing the car is surrounded by good driving condition before you gain behind the week. Your mother will not be awarded anything above medical bills (if she even gets that- she may go and get nothing since shes likely on the policy.)
Call your insurance and tolerate them explain to you your injury benefits. But please be aware you ARE at fault.. and will get nought above medical bills IF THAT.
